Notification of Resignation of Councillor and Process for Filling Vacancy

As required by Schedule 4.1A of the Local Government Act 1995, the Shire can now offer the position to the first unelected candidate from the 2023 ordinary election, Christian Gibbs, without needing to hold an extraordinary election. The Shire has 10 business days to work with the first unelected candidate (Christian Gibbs) to fill the vacancy.

The filling of the vacancy by the first unelected candidate will follow the provisions of Clause 12 in Division 4 of Schedule 4.1A of the Local Government Act 1995.

The Shire of York will provide an update to the community on the outcome of this process in line with the legislative requirements of 10 business days.
